Royal Oak Medical Marijuana Hearing Postponed

Lawsuit seeks to prohibit the city from restricting the growth of pot for medical purposes.

A court hearing aimed at blocking Royal Oak's restrictions on medical marijuana has been postponed.

The hearing seeking an injunction prohibiting the city from restricting patients and caregivers from growing their own marijuana for medical purposes was to have taken place this morning before Oakland Circuit Judge Rudy Nichols.

Royal Oak resident newly enacted city zoning restrictions that prohibit patients or caregivers from growing medicinal marijuana in city residences. Brook is qualified to receive medical marijuana treatments under state law, according to his attorney, Joseph Niskar of Detroit. Brook ultimately seeks a jury trial aimed at overturning the ordinance.

A spokeswoman for Niskar’s office announced Tuesday afternoon that he had requested and received a hearing postponement with a makeup date yet to be set.

State voters legalized the distribution of medical marijuana in 2008. Since then, a number of Michigan cities have sought to place restrictions on home cultivation.

Another Royal Oak resident, Christopher Frizzo, has also filed a lawsuit over the city’s restrictions, which went into effect Feb. 4.
